GENERAL POLICIES

 

1. Please have your units on the premises as early as possible to avoid the last minute rush. Units must be Represented accurately and fairly. Unsafe vehicles will be towed across the auction block.

 

2. No vehicle will be offered for sale without the V.I.N. plate attached in the designated area. The auction reserves the right to refuse the sale of any vehicle in which the identification plate appears altered in any way. Such vehicles may be subject to seizure.

3. NO RETAIL CUSTOMERS ALLOWED.You must be a licensed and registered dealer to buy or sell. Any dealer who brings a retail customer into the lanes is subject to a 60-day suspension.

4. All persons entering the lanes must be a minimum of 18 years old. The probability of children being injured while running among vehicles in the lanes or on the lot makes it necessary to enforce the policy of "no children" at the auction.

5. DEALERS MUST CARRY I.D. CARDS AT ALL TIMES. If your card is lost or badly worn, a new card will be made in the auction’s registration office upon request. Please help us serve you by always using your I.D. card. In order to buy or sell, a dealer's bidder number must be clearly displayed at all times.

6. All consigned vehicles must be offered for sale on the block prior to leaving auction premises.

7. All transactions must be cleared through the office. Anyone found dealing outside of the sale in order to avoid sales fees will be subject to suspension or being permanently barred.

8. All vehicles are consigned at the owner’s risk. The auction is NOT liable for theft or damage to any vehicle left at the auction. Sellers are advised to remove personal property, cellular phones, etc. from their vehicles prior to checking in the vehicle.

9. Auction fees are available in the front office.

10. Purchased vehicles left on the lot after 5 working days are subject to storage charges of $10 per day, per vehicle.

11. Auction Management reserves the right to refuse service to anyone.

12. Sellers will not offer for sale any vehicle which does not comply with current Federal and State Regulations.

13. All Canadian vehicles must be announced at the time of sale.

14. ALL WARRANTIES & REPRESENTATIONS, (E.G., RIDE AND DRIVE), ARE THOSE OF THE SELLER ONLY. THE AUCTION MAKES NO WARRANTIES IMPLIED OR EXPRESSED. AUCTION BEARS NO RESPONSIBILITY FOR "COURTESY ANNOUNCEMENTS", I.E. WINDOW MARKINGS, EQUIPMENT, ETC.

15. THIS AUCTION IS NOT A PARTY TO THE CONTRACT OF SALE WHICH IS BETWEEN THE SELLER AND BUYER ONLY. THIS AUCTION IS NOT THE TRANSFERRER REQUIRED TO GIVE THE FEDERAL ODOMETER MILEAGE STATEMENT IN CONNECTION WITH ANY SALE/AUCTION WITHIN THE CONTEMPLATION OF THE MOTOR VEHICLE INFORMATION COST SAVINGS ACT OF 1972, AS AMENDED, OR SIMILAR LAWS: THE SELLER IS THE TRANSFERRER WITHIN THE CONTEMPLATION OF SUCH LAWS.

16. SELLER IS RESPONSIBLE FOR ENSURING THAT VEHICLES SOLD WITH COS,MSO, OR AFFIDAVITS ARE VALID IN BUYING DEALER’S STATE. STATUS OF LUXURY TAX ON VEHICLES SOLD BY MSO ARE NOT SUBJECT TO ARBITRATION.

 

RESERVED NUMBERS

 

17. All Sale Day Reserved Numbers must be cancelled by 5:00 on Tuesday prior to the Wednesday Sale OR a $25 NO SHOW Fee will be charged.

 

PAYMENT

 

18. BUYERS must pay for all purchases on the DAY OF THE SALE. Buyer's method of payment is subject to auction approval.

19. “CASH-ONLY” customers must pay for units prior to obtaining a gate pass. Auction reserves the right to require a cash deposit from "CASH ONLY" customers.

20. Unless a buyer has obtained prior written approval from the auction’s General Manager or Business Manager, buyers failing to pay for a unit on sale day will be subject to a minimum late payment fee of $50 per week per vehicle.

21. All returned checks or drafts will be charged a $50.00 minimum “returned check or draft fee.”

Note: These fees and charges must be paid prior to a buyer receiving title for the vehicle. Buyers with unpaid purchases are subject to being barred or suspended from purchasing at the auction.

22. Seller checks are subject to a 2 hour hold from time of sale for administrative purposes.

IF SALES

23. All counter sales are “AS-IS.” No exceptions.

24. All conditional sales “IFs” are binding on the buyer for two (2) hours, contingent upon seller’s approval.

25. For all conditional sales, the auction reserves the right to sell any unit if the bid is within $200.00 of the seller’s floor price.

ANNOUNCEMENTS

26. Selling Descriptions: “light systems”

GREEN LIGHT: “RIDE AND DRIVE”

Vehicle is mechanically “sound” within $400.00 per defect.

YELLOW LIGHT: “CAUTION”

Vehicle is mechanically “sound” within $400.00 except for announced defects.

RED LIGHT: “AS IS”

Sold without warranty or guarantee of any kind, including year.

BLUE LIGHT: “TITLE ATTACHED”

Vehicle sold without title present on sale day.

Note: See manufacturers rules for any exceptions.

27. VEHICLES WHICH MUST BE SOLD AND ANNOUNCED “AS IS”

(i.e. red light):

A. Flood damaged vehicles

B. Boats

C. Recreational vehicles

D. Motorcycles

E. Trailers

F. Salvage or rebuilt title vehicles

G. Miles over 100,000

H. Not Actual miles (i.e., true miles unknown) or over mechanical limits

I. Equipment (e.g., farm equipment, etc.)

J. Rebuilt Vehicle

28. REGARDLESS OF AN “AS IS” SELLING DESCRIPTION (SEE 28. BELOW FOR EXCEPTION) THE SELLER MUST ENSURE THAT THE FOLLOWING CONDITIONS ARE ANNOUNCED AT THE BLOCK PRIOR TO UNIT BEING OFFERED. FAILURE TO MAKE SUCH ANNOUNCEMENTS MAY RESULT IN ARBITRATION AND

POSSIBLE TURNDOWN:

A. Police Cars

B. Taxi-cabs

C. Municipal cars

D. Not actual miles, non-working odometer, or in excess of mechanical limits (vehicles 10 years or older, are exempt from making this announcement)

E. Kit cars

F. Frame damage or frame repairs

G. Diesel engine/conversions

H. Flood damage

I. Hail damage

J. Missing emission systems

K. Vehicles possessing reassigned public V.I.N.s

L. COs, MSOs, Repo affidavit titles must be announced

M. Vehicles not equipped with air conditioning

N. Previous paint and/or body repairs (current calendar year models only)

O. Salvage or rebuilt vehicles

P. Canadian Conversions

Q. Missing or inoperable airbag. Airbag light are subject to inspection and diagnosis

29. IF AN “AS-IS” VEHICLE SELLS FOR $2000 OR LESS, UNIT CAN ONLY BE ARBITRATED FOR UNDISCLOSED SALVAGE HISTORY OR ODOMETER DISCREPANCIES UNLESS SELLER ANNOUNCES

GREEN LIGHT GUARANTEE.

30. Seller is responsible to ensure the year model and odometer information contained on the bill of sale is accurate before signing the bill of sale at the block. The auction accepts no responsibility for errors or missions. The seller is also responsible for ensuring that all announcements, including courtesy announcements (see the announcements above) are made at the block. Failure to do so may result in the unit being rejected.

 

ARBITRATION

 

31. Vehicles must be entered into arbitration by 5 p.m. on the day of the sale. For night sales, the time limit will be one hour after the sale is completed. Vehicles will NOT be allowed into arbitration after these deadlines. IMPORTANT: Thoroughly check and test drive every “ride and drive” car before settlement. If there is any problem, a proper complaint must be filed with the arbitration office within the stated timeframes. The unit must not leave the auction premises prior to arbitration.

32. THE FOLLOWING CANNOT BE ARBITRATED:

A. Clutches

B. Electrical equipment

C. “Service soon” or “check engine” lights

D. Inoperable air-conditioning

E. “AS-IS” vehicles selling for $2000 or less

(exception: odometer or salvage) Unless seller announces “Green Light Ride & Drive Guarantee”

F. Visible items such as body work, paint work (except for current model year vehicles)

G. Tires

H. Upholstery

I. Glass

J. Radios

K. Other items which would reasonably be discovered on a pre-purchase inspection of the vehicle; non-working odometer and speedometer must be arbitrated before gate released.

L. ABS Lights

M. Windshield writing: Courtesy announcements describing equipment, make, model, miles, trim level, etc.

N. Invalid or voided manufacturer warranties.

O. Missing or inoperable high-security or valet keys.

33. If a seller misrepresents a vehicle which is turned down, the seller will be responsible for all auction charges which include both the buyer and seller fees, transportation cost or other reasonable expenses.

34. Undisclosed frame damage/repairs, flood damage, odometer or undisclosed rebuilt units must be arbitrated within seven (7) days of purchase. Day of sale is day one.

35. All Canadian vehicles must be announced at the time of the sale.

36. Arbitration manager’s decision shall be final in all disputes. Manufacturer's rules will apply as posted.

37. The auction tape records all sales to facilitate with arbitration.

38. Any third party reporting agency (Carfax, Autocheck, etc.) items are subject to verification and inspection by the auction. The auction reserves the right to make the final decision.
 

TITLES

39. All “title attached” or “title absent” sales must be announced at the block.

40. If the title is not produced within 30 calendar days beginning with the day of sale, the buyer may cancel the sale provided the buyer has notified the auction and received a valid return authorization number.

41. Buyers are cautioned not to sell or spend money on “title attached” or “title delay” vehicles until the title is received.

42. After the 30th day, if the seller presents title and is paid prior to buyer notifying the auction of rejection, the buyer will be required to keep the vehicle.

43. If the seller does not surrender a transferable title to a sold vehicle AT THE BLOCK, he/she will be charged a “title attached” fee. Current fees are available in the front office.

44. There is an additional $50.00 “late title fee” charged to the seller if a title is not presented within 30 days.

45. It is the seller’s responsibility to ensure that a title is negotiable in the buyer’s state.

46. COs, MSO and Repo affidavit titles must be announced at the block.

GOLDEN EAGLE RULES

See current Golden Eagle rules as posted in the lanes.

47. 36,000 or less miles.

 

48. No paint or body work except for painted bumpers.

49. No mechanical defects.

50. All Golden Eagle purchases must be arbitrated within 7 days.

51. Golden Eagle cars must be inspected by 5 PM Tuesday. Should a vehicle be received after 5 p.m., and then be rejected, the seller is subject to a vehicle rejection fee.

52. NOTE: WE MAKE EVERY EFFORT TO INSURE VEHICLES IN THIS LANE CONFORM TO THESE STANDARDS. EVERY “GOLDEN EAGLE” IS INSPECTED PRIOR TO SALE. WHILE WE USE OUR BEST JUDGEMENT IN THE QUALIFYING PROCESS, ALL REPRESENTATIONS AND WARRANTIES ARE THOSE OF THE SELLER ONLY. THE AUCTION MAKES NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESSED OR IMPLIED.

ODOMETERS

53. Anyone selling an automobile through the auction with a tampered odometer is liable for that vehicle, whether they are directly or indirectly involved. Those who are directly involved are subject to being barred permanently.

54. Sellers are required to make the proper announcements, at the block,

concerning a vehicle’s odometer status, as required by Federal and State Law.
